Updated Illinois Child Custody Laws

Thanks to recent family law updates, the term "child custody" is no longer a part of Illinois legal terminology. The changes also eliminated sole vs. joint custody and are now geared more towards the best interests of the child. Previously-entered orders will still contain sole or joint custody language, however, and new determinations will consider a primary residential parent that may have the majority of parental responsibility in the child's life.

Similarly, the term "visitation" was replaced with "parenting time" phrasing for the new family law changes. Each parent will be allotted certain parenting time rights, with the primary residential parent possibly retaining most of the time with the child. Parenting time for non-parents, such as grandparents, is still considered visitation.

Effective parental responsibility agreements are best reached when both parties work together cooperatively. If parents need additional resources to reach an agreement, we can help with an evaluation.
