Obtaining a Restraining Order
If you concerned about your safety or the safety of your children, you can ask the court to issue a restraining order preventing your abuser from having contact with you, your children, and others close to you. Initially the court will provide a temporary restraining order. You must attend the hearing but your abuser need not be present.
In order to obtaining a permanent order of protection (which will be in place for a year or more), you will need to go back to court for a second hearing. At this hearing, the other person may be present to argue that there should not be a permanent order. Your attorney will need to provide evidence on your behalf for why the permanent restraining order is needed.
