Wheaton Restraining Order Attorneys

Experienced Schaumburg Lawyers Assist in Obtaining Domestic Violence Restraining Orders

During the emotionally difficult time leading to and during a divorce, it's not uncommon for a spouse to suffer from or inflict physically abusive or threatening behavior. Despite the understandable stress and difficulty of your situation, it is never okay to resort to violence. If you have been victimized, you do have rights!

The family lawyers at Anderson & Associates, P.C. care about your safety and the safety of your children.

For swift, discreet, and assertive handling in cases of domestic assault, child abuse, or stalking, contact the lawyers of Anderson & Associates, P.C. or call 847-995-9999 (Schaumburg office) or 630-653-9400 (Wheaton office) to schedule a free consultation.

Obtaining a Restraining Order

If you concerned about your safety or the safety of your children, you can ask the court to issue a restraining order preventing your abuser from having contact with you, your children, and others close to you. Initially the court will provide a temporary restraining order. You must attend the hearing but your abuser need not be present.

In order to obtaining a permanent order of protection (which will be in place for a year or more), you will need to go back to court for a second hearing. At this hearing, the other person may be present to argue that there should not be a permanent order. Your attorney will need to provide evidence on your behalf for why the permanent restraining order is needed.

Handling False Allegations of Assault or Abuse

Threats and allegations of abuse are unfortunately becoming more common in contested divorce and custody disputes. When our clients are named in a restraining order as a tactic to remove them from the house in order to get the upper hand in a divorce, we quickly investigate the case in order to provide our client with a vigorous defense.

For experienced legal representation in cases of domestic abuse and divorce, contact the lawyers of Anderson & Associates, P.C. or call 847-995-9999 (Schaumburg office) or 630-653-9400 (Wheaton office) to schedule a free consultation.
