Illinois Mediation Lawyers

Knowledgeable Mediation Attorneys Serving Wheaton and Schaumburg

The issues that arise and are resolved in family law can demand a different approach and skill set than other areas of practice. Mediation is a good example of a legal process that is particularly well suited to the delicate nature of family law issues such as divorce, allocation of parental responsibility (or child custody), and division of assets. For many individuals facing these challenging decisions, enlisting the services of a third-party mediator and an attorney with experience in mediation is the best decision. Anderson & Associates, P.C. can help you navigate the mediation process as your Illinois mediation attorneys.

Mediation Overview

When individuals decide to use mediation to resolve a family legal matter, they hire a mediator. This mediator serves as a neutral third-party who helps the clients and their attorneys work towards an equitable resolution to the issue or issues at hand. Both individuals hire separate attorneys to represent their interests in the mediation, and together the attorneys, clients, mediator, and any other specialists that are consulted work in a collaborative effort toward resolution. Any disclosures made over the course of the mediation proceedings are confidential and cannot be used in court if the mediation fails. Once the parties have come to an agreement, the agreement is presented to a judge and made official.

Mediation Pitfalls

Mediation is a great approach if both parties are open to discussion and compromise. However, if that is not the case, mediation may not be the best choice for your situation.

Advantages to Mediation

One of the most obvious advantages of mediation, particularly in family law, is that it encourages the parties to work together rather than to see each other as adversaries. For this reason, mediation is frequently used for issues surrounding a divorce, such as alimony/maintenance, parental responsibility, establishing and/or changing parenting time (visitation) schedules, distribution of assets, child support, or relocation. Additionally, mediation can be faster and less costly than a traditional divorce proceeding.
